LSP Products Group, Inc. et al. v. K-Flex USA, LLC et al. (NDTX, Dallas)

Case Overview

LSP Products Group, Inc., together with Danco, Inc., and PPG, Inc. (collectively, “the plaintiffs”), sued K-Flex USA, LLC, along with its Mexican affiliate, K-Flex de Mexico, S. de R.L. de C.V. (collectively, “K-Flex”), in Texas state court alleging causes of action for breach of contract and fraud. The case was recently removed to the United States District Court for the Northern District of Texas, Dallas Division. K-Flex is a multinational manufacturing company specializing in the production of thermal and acoustic flexible elastomeric insulation materials, and the plaintiffs are distributors of K-Flex products. The plaintiffs allege that K-Flex defrauded the plaintiffs and breached the parties’ agreements by providing direct distribution of K-Flex products in competition with the plaintiffs’ distribution of K-Flex products. The plaintiffs seek unspecified actual, consequential and uncapped punitive damages, as well as attorney’s fees. Partner Daniella Main of Vartabedian Katz Hester & Haynes LLP, with assistance from partner Craig Haynes and associate Weldon Sloan, are serving as local counsel in this matter. As local counsel, they have assisted with identifying issues unique to state and federal court practice in Dallas, Texas, and have provided substantive legal support to lead counsel Mitch Armbruster of Smith Anderson in Raleigh, North Carolina. The case is in its initial pleading stages in federal court and has not yet been set for trial.
