Richard Guiltinan is an experienced civil litigator who works in the firm’s White Collar and Investigations practice. Before joining Vartabedian Katz Hester & Haynes, he worked as an Assistant United States Attorney in the Northern District of Texas, where he handled False Claims Act investigations and served as the Civil Healthcare Fraud Coordinator. He also defended the United States in federal tort cases and administrative challenges.

Richard’s practice covers a broad range of healthcare matters, ranging from the Anti-Kickback Statute and the Stark Law to Medicare payment disputes. His expertise with the “reverse FCA” provisions of the False Claims Act applies to investigations involving tariffs and trade obligations as well as federal program overpayments.

  • Negotiated False Claims Act settlements with physicians, practice groups, and healthcare facilities for allegations involving wound care procedures, billing, marketing, and medically unnecessary services.
  • Negotiated Controlled Substances Act settlements for alleged recordkeeping, prescription, and storage violations.
  • Obtained multiple dismissals and judgments in favor of the United States when defending agency actions in administrative matters.
