Tarrant County Senior Living Center, Inc. d/b/a The Stayton at Museum Way (“Stayton”)
Represented Stayton in a prepackaged chapter 11 case implementing the restructuring of Stayton’s bond debt. Our attorneys represented the Plan Sponsor in the out of court acquisition of the Stayton, filed the chapter 11 case, and consummated the transaction through a prepackaged plan that was accepted by holders of more than 99% of bonds by amount and approximately 95% of bondholders by number. Creditor Committee Representations
PrimaLend Capital Partners, LP
Retained to represent the Official Committee of Unsecured Creditors of PrimaLend Capital Partners, LP, a Texas-based subprime auto lender that specializes in providing financing solutions to “buy-here-pay-here” auto dealerships. PrimaLend’s bankruptcy filing on October 22, 2025, comes after months of negotiations with its creditors following missed interest payments on its debts due to an unexpected increase in delinquencies and repossessions. The unsecured creditors committee includes (i) Meir Benit Trust, (ii) Jacob Mason, and (iii) Earth Enterprises LLC. The case outcome was covered in Law360.
Omnicare, LLC
Retained to represent the Official Committee of Unsecured Creditors for Omnicare, LLC, a CVS Health subsidiary, to address liability related to a recent $1 billion False Claims Act judgment entered against it in the U.S. District Court for the Southern District of New York. The unsecured creditors committee included (i) Uri Bussan, the relator in a False Claims Act suit against Omnicare, (ii) McKesson Corporation, (iii) the International Association of Machinists and Aerospace Workers, and (iv) the Institute of Nursing Excellence d/b/a Heartworks, IV. Anthology, Inc.
Retained to represent the Official Committee of Unsecured Creditors to the Official Committee of Unsecured Creditors of Anthology, Inc., a global provider of education technology (EdTech) software and services, and parent company to Blackboard Learn. Burdened by more than $1 billion in debt, Anthology sought Chapter 11 protection in the Southern District of Texas in late 2025. The unsecured creditors committee includes (i) Genius SIS LLC, (ii) Glass Technologies Inc., (iii) A-LIGN Compliance and Security Inc. d/b/a A-LIGN, and Avalara, Inc. Zynex, Inc.
Chosen to represent the Official Committee of Unsecured Creditors for Zynex, Inc., a medical technology company specializing in the manufacture and sale of non-invasive medical devices for pain management and rehabilitation with over $66.7 mm in debt. The unsecured creditors committee includes (i) U.S. Bank Trust Company, N.A., (ii) Savant Labs, Inc., (iii) Allstate Insurance Company, and (iv) Dr. Raelynn Maloney. Bon Voyage Holdings, LLC (“BVH”)
Represented BVH in the chapter 11 cases of Hornblower Holdings and affiliates. BVH was the second largest unsecured creditor of the Debtors and was also a significant shareholder, having been formed by Hornblower’s founder and former CEO, Terry MacRae. VHH represents BVH and Mr. MacRae in connection with their claims against the debtors.
Other Representations
Led representation in several major chapter 11 debtor cases including SemGroup, Crescent Resources, Texas Rangers Baseball Partners, Blockbuster and Dallas Stars, and co-led representation of Enron and Pilgrim’s Pride.
Led the restructuring of Georgia Proton Treatment Center, culminating in the completion and opening of Emory Proton Therapy Center at Winship Cancer Institute of Emory University.
Represented The Western Company of North America, Zale Corporation, MCorp, Edison Brothers Stores, Inc., and PennCorp Financial Group, Inc. in Chapter 11 cases.
Led representation of Sulzer Orthopedics in its class-action product liability settlement which allowed that company to avoid seeking relief under the Bankruptcy Code.
Led representation of acquirors of Synagro Technologies, Option One Mortgage, Fitz & Floyd, Trenwick America and the Specialty segment of International Shipholding Corporation.
Represented US ONE Communications Corp., Heartland Wireless Communications, Verado Holdings and Hedstrom Corporation in chapter 11 cases.
Represented statutory creditors’ committees for First Republicbank Corporation, Texas American Bancshares, National Gypsum Company and New Valley Corporation.
Led representation of major financial institutions and other creditors in a number of cases including The Commonwealth of Puerto Rico, Powerwave Technologies, First Magnus, Harbor Financial Group, FirstPlus Financial Group, Genesis Physicians Practice Association, Mirant, Senior Living Properties, Williams Communications and Covad, as well as in numerous out of court restructurings.
