Case Overview
Represented Point Energy- a Texas-based oil and gas operator, in a dispute involving whether oil and gas leases in Loving County, TX terminated or were maintained by operation of the leases’ force majeure clause. Obtained summary judgement in Point’s favor. After an intermediate court of appeals reversed summary judgement, Point Energy successfully obtained discretionary review for the Supreme Court of Texas, which unanimously reversed the intermediate appellate court and reinstituted the trial court’s order that the leases were not maintained by force majeure. The resulting opinion, which received extensive media coverage in publications like The Texas Lawbook, is the seminal force majeure case in Texas jurisprudence. Point Energy Partners Permian, LLC v.
