Case Overview

Rachelle “Shelley” Glazer is representing Houghton Properties, Ltd. d/b/a Securlock Storage at Fort Worth in a dispute with Certain Underwriters at Lloyd’s London and its third-party adjusting company, Synergy Adjusting Company, over the denial of a coverage claim for property damage to Houghton’s retaining wall and privacy fence (“the wall”) at 3500 Riverbend Blvd., Fort Worth, Texas. The wall was destroyed by high wind during a windstorm on October 4, 2023, and the damages are at least $841,000, plus $75,000 in attorneys’ fees that are accruing. The insurer has taken the position that the wall fell due to differential settlement and lateral earth pressure, hydrostatic pressure and inadequate drainage. Vartabedian Katz Hester & Haynes LLP has sent a notice and demand letter to the insurer and Synergy Adjusting and is prepared to litigate, additionally seeking 18% per annum interest and treble damages, if the matter cannot be resolved.
