Case Overview
Represented BPX Properties, Cimarex Energy Company, and Prize Energy Resources in a lawsuit brought by former Texas House Speaker regarding the alleged “washout” of certain overriding royalty interests carved out of an oil-and-gas lease in Reeves County, Texas. Successfully obtained summary judgment that no common law “bad faith” ORRI washout claim exists in Texas, and that BPX complied with its lease obligations when exercising its right to surrender the lease in question. In 2026, the unanimous El Paso Court of Appeals affirmed the trial court’s judgment.
